Welcome to Mini Mascot! These Terms and Conditions ("Terms") govern your use of our website www.minimascot.com.au (the "Site") and your purchase of products from Little Safari. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.

1. Acceptance of Terms

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Eligibility

To place an order on our Site, you must be at least 18 years old and have the legal capacity to enter into binding contracts.

3. Account Registration

To use certain features of the Site, you may need to create an account. You agree to provide accurate and complete information during registration and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Orders

4.1. Order Acceptance

All orders placed through our Site are subject to acceptance by Little Safari. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product descriptions or prices, or suspected fraud.

4.2. Pricing and Availability

Prices and availability of products are subject to change without notice. We strive to provide accurate information, but errors may occur. If we discover an error in the price or availability of a product you have ordered, we will notify you and provide the option to proceed with the order at the correct price or cancel the order.

5. Payment

We accept payment through various methods as indicated on our Site. By providing payment information, you represent and warrant that you are authorized to use the payment method and that you authorize us to charge the total amount of your order.

6. Shipping and Delivery

6.1. Shipping Policy

We ship products within Australia. Shipping costs and delivery times are calculated at checkout and may vary based on your location and the shipping method selected.

6.2. Delivery

Delivery times are estimates and not guaranteed. Little Safari is not responsible for delays caused by factors beyond our control, including but not limited to carrier delays, customs processing, or weather conditions.

7. Returns and Refunds

7.1. Return Policy

If you are not satisfied with your purchase, you may return it within 30 days of receipt for a refund or exchange, subject to our Return Policy. Products must be returned in their original condition and packaging.

7.2. Refunds

Refunds will be processed within 14 days of receiving the returned product. Refunds will be issued to the original payment method. Shipping costs are non-refundable.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Little Safari or its licensors and is protected by Australian and international intellectual property laws. You may not use, reproduce, or distribute any content from the Site without our prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Little Safari shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Site; or (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of QLD, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of QLD, Australia.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.

Mobile Terms of Service

The Mini Mascot mobile message service (the "Service") is operated by Mini Mascot (“Mini Mascot”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Mini Mascot’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Mini Mascot through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Mini Mascot. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to MiniMascot or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Mini Mascot mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
